Abstract: 
The starting point of the theory of contracts coincides with the Roman era, but the moment related to the strengthening of the contract theory is the "social contract". Another episode relevant to this theory is represented by the trend "institutionalism". The institutional value has repercussions on the value of the concluded contracts, but we notice the link between the notary public institution and the theory of contracts, which is very important. Although the notary public institution is important in a democratic society, the analyses conducted do not indicate any connection between the number of notaries public and economic growth.
