Abstract:
Die drückende Finanznot vieler Kommunen lässt Wissenschaft und Praxis nach einer grundsätzlichen Lösung der Schuldenproblematik suchen. Dabei rückt zunehmend das Insolvenzverfahren für Kommunen in den Fokus. Es wird als eher marktwirtschaftlichautonom wirkender Lösungsmechanismus den vielfach wirkungsschwachen politischrechtlichen Regelungen vorgezogen. Die deutschen Kommunen unterliegen allerdings einer grundgesetzlichen Garantie der Selbstverwaltung, sodass die Möglichkeit einer praktischen Umsetzung dieses Verfahrens fraglich bleibt.

Many municipalities in Germany suffer from fiscal distress. The high level of communal debt seems problematic against the background of the European sovereign debt crisis. The regulation of bankruptcy and insolvency for German municipalities could be a solution, but such regulation would have to take their specifi c characteristics into consideration. On the one hand, the consequences of a collapse of local authorities would be harsh and would further limit the scope of German municipalities. On the other hand, doing nothing is not an option, because the problems require a fundamental solution.
