Abstract: 
Der Aufkauf von Asset Backed Securities und Pfandbriefen am Markt und ein eventueller Staatsanleihenaufkauf durch die Europäische Zentralbank (EZB) werden ihre Bilanz weiter aufblähen. Etwaige Verluste aus den vorgenannten Maßnahmen gehen zulasten der Gewinne, Gewinnrücklagen oder des Kapitals der EZB. Eine Belastung des deutschen Staatshaushalts mit einem Verlustanteil gemessen am deutschen EZB-Kapitalanteil und damit des deutschen Steuerzahlers ist nicht auszuschließen. Vor diesem Hintergrund stellt sich die Frage, ob die damit einhergehenden Vermögensumverteilungen innerhalb der Eurozone mit den Wertungen des Grundgesetzes, insbesondere der Eigentumsgarantie und den Vorgaben für die Steuergesetzgebung vereinbar sind. Vermögensumverteilungen werden in einem demokratischen Bundesstaat durch die Steuergesetzgebung und einen Länderfinanzausgleich realisiert. Entsprechende Rechtsgrundlagen existieren auf europäischer Ebene nicht, da die politische Union nicht verwirklicht ist.
Abstract (Translated): 
The European Central Bank has announced to buy in a first step asset backed securities and mortgage loans for about 500 billion euros. The rating of these assets could be under the level of "A-". The new program of the ECB intends to shorten the balance sheets of European banks and give a stimulus for the weak economies of some member states of the euro zone. In former days the ECB accepted for refinancing banks only "A-" and better rated securities. Furthermore the ECB has announced - if necessary - to start a quantitative easing program by buying state loans to fight against deflation in the euro zone. These measures will inflate the balance sheet of the ECB. Losses resulting out of these programs will harm the euro member states as the shareholders of the ECB capital. In the end tax payers of economically strong euro member states could be obliged to pay the bill. The border line between money and tax policy could be disregarded by the new programs of the ECB. The programs could spread assets of rich euro zone member states on economically weak euro zone member states. The principle of "No-bail-out" of the European treaties could be hurt.
