Abstract: 
Die Überlegungen in dieser Arbeit beziehen sich auf eine Neugestaltung der Regelaltersgrenze der gesetzlichen Rentenversicherung und der Altersgrenzen, zu denen bei gleichzeitigem Bezug einer Altersrente und eines Arbeitseinkommens ein gleitender Ausstieg aus dem Erwerbsleben vollzogen werden kann. Als Ergebnis zeigt sich, dass sich bei einem vorgezogenen Bezug einer Voll- oder einer Teilrente mit 60 Jahren und einer Teilweiterbeschäftigung bei Einhaltung des Äquivalenzprinzips erhebliche Renteneinbußen einstellen und bei dem gegenwärtig niedrigen Rentenniveau die Gefahr besteht, in die Grundsicherung für Ältere zu fallen. Es ist daher angebracht, einen vorgezogenen Renteneintritt davon abhängig zu machen, dass eine Beanspruchung der Grundsicherung für Ältere nicht eintreten wird. Für den Fall der Flexibilisierung der Erwerbsphase über die Regelaltersgrenze hinaus muss die Koppelung der Befristung des Arbeitsvertrages an die Regelaltersgrenze aufgehoben werden. Zugleich muss aber die "Regelaltersgrenze" als Bezugspunkt für die Berechnung der Zu- und Abschläge bestehen bleiben. Geregelt werden muss auch, dass bei einer Verlängerung der Erwerbsphase über die Regelaltersgrenze hinaus weiterhin die Beitragspflicht der Arbeitnehmer und Arbeitgeber zur Sozialversicherung bestehen bleibt. Abstract (Translated): 
In this paper we reflect on the developments around statutory retirement ages for full state pensions as well as looking at the age limits set for a phased withdrawal from working life where there is income obtained from both a pension and continued employment. The results indicate that, when adhering to the principle of equivalence, the choice to retire early at 60 years old on a full or partial pension combined with part-time work leads to a heavy reduction in the pension and, given the currently low pension level, a corresponding danger of slipping below the subsistence level for the elderly. It is therefore appropriate to make the possibility of early retirement dependent on the retiree not having to subsequently apply for public support to reach the subsistence level for the elderly. With relation to enabling workers to continue in employment beyond the statutory retirement age, the regulation coupling the limiting of work contracts to the statutory retirement age must be removed. At the same time, however, the statutory retirement age must be maintained as the basis for calculating any reductions or premiums. One further point which much be addressed is that in the case of a worker continuing in employment beyond the statutory retirement age, the mandatory payment of social contributions by both the employer and employee must continue.
